GENERAL TERMS AND CONDITIONS FOR SHORT-TERM TOURIST RENTALS OF PROPERTIES FOR A DURATION OF LESS THAN 30 DAYS pursuant to Article 1 comma 2 lettera c della Legge 431/98 - (Esente da registrazione ex art.2bis Dpr 26 Apr 1985 n° 131)
By sending the confirmatory deposit and therefore finalizing your reservation, you will approve our contractual conditions as detailed below.
RENTAL
The property is rented out temporarily at the agreed price at the time of the request, which usually corresponds to the one published on the website. Any subsequent variations, whether higher or lower, of the price published on the website do not affect the agreed and approved price, which remains unchanged. The property is leased exclusively for tourist purposes pursuant to Article 1, paragraph 2, letter c), of Law No. 431/98. Subleasing, lending for use, or transfer of possession to any other third party or requesting residence or domicile in the same property is expressly prohibited.
PRICES
The prices are inclusive of utilities and taxes, except for the possible tourist tax. Some facilities require a mandatory final cleaning fee, which, if applicable, will be indicated in the contract proposal. Bed linen and towels are not provided and it is the customer's responsibility to bring them. In residential facilities, it is possible to rent them at a cost of €10.00 per person for each set, to be requested upon booking.
AVAILABILITY OF ACCOMMODATION AND BOOKING
The AGENCY will communicate the availability of the chosen accommodation by sending a contract proposal via email, which will include:

Surname and first name of the reservation holder

Arrival and departure dates with accommodation delivery and return times

Number of Occupants (no more persons are allowed than indicated)

Indication of the deposit payment method to be made within 5 days from the receipt of said proposal, after which it will be automatically canceled and the agency reserves the right to refuse deposits that arrive after this deadline.
INFORMATION
At the same time as sending the data for the deposit payment, the customer will be informed of the exact location of the property, the type with the number of beds available, and various services. It is the customer's responsibility to fully inform themselves about the property they are booking, including size, composition, equipment, and to accept that the area where it is located is to their liking.
VALIDITY OF RESERVATION AND PAYMENT
The reservation is considered valid only after payment of the required deposit, and the rental is considered finalized when the customer receives, as soon as the deposit amount is credited, the Confirmation Reservation Letter
DEPOSIT
The confirmatory deposit, communicated with the proposal, usually equal to 30% of the rent, must be paid within 5 days of receiving our "contract proposal" via bank transfer, the agency reserves the right to refuse deposits that arrive after this deadline.
BALANCE
The rental payment must be paid upon key delivery, which will take place at our offices in Via di Mille 73, via debit card, credit card, and cash, and the already paid deposit will be credited towards the rent.
TERMINATION AND WITHDRAWAL
For cancellations communicated 4 weeks in advance, a full refund of the entire deposit is provided; no refunds are provided for cancellations communicated beyond this deadline.
ARRIVAL, NON-ARRIVAL, AND EARLY DEPARTURE
Arrival and key delivery are scheduled at the agency From 16:00 to 20:00, on the day indicated as the beginning of the stay, identification documents of all occupants of the accommodation will be required for registration. The accommodation will be delivered in order and clean, and additionally, a refundable security deposit of 100.00 euros will be required upon arrival, to be refunded upon departure after the final inspection of the accommodation, provided there are no damages.The accommodation will be available until 10:00 am the following day, after which the AGENCY will consider itself free to rent it to third parties. In the event that the customer departs earlier than the agreed term, they are not entitled to any reduction in the rent under any circumstances, and consequently, they cannot request a refund of what has been paid.
RULES OF STAY AND PENALTIES FOR NON-COMPLIANCE
No persons other than those who have booked may stay in the accommodation, and a number of persons (including adults and children) exceeding that indicated at the time of booking shall result in early termination of the contract pursuant to Article 1456 of the Civil Code, unless communicated in advance and expressly authorized by the agency. Guests are required to respect the condominium regulations, to scrupulously observe common rules regarding peace, especially in the afternoon and nighttime hours, avoiding disturbing noises and shouting. Guests undertake to take utmost care of the apartment (walls, floors, etc.), household appliances (dishes, refrigerator, stove, etc.), and furnishings (furniture, beds, tables, etc.). Any damaged or stolen items must be compensated by the customer. Complaints regarding the condition of the apartment and its accessories are accepted only within 24 hours of arrival. Small pets (up to 8 kg) are allowed, to be indicated at the time of booking, only if accepted in advance, at an additional cost of 50.00 euros per pet
The use of personal heaters, electric stoves, or air conditioners is not allowed.
With reference to such behavioral rules of stay, especially but not limited to those relating to the number of tenants, the care of apartments and rooms, and the respect of peace, the AGENCY reserves the right to inspect the premises at its sole discretion, even in the absence of tenants, in order to verify their scrupulous compliance. Should serious violations emerge from the inspection, the Lease shall be deemed terminated by law, with immediate effect, due to the Customer's default, and the AGENCY may demand the immediate vacating of the premises, availing itself, if necessary, of public force, without making any refund of the rent or other paid services. Without prejudice to any right to claim compensation for any damages.
APARTMENT FACILITIES
All apartments are delivered fully furnished and equipped with a gas stove, refrigerator, kitchenware (pots, plates, glasses, utensils), hot and cold running water, and 220-volt electricity. Gas supply is provided through the local network . One blanket and one pillow are available for each bed. The Customer only needs to bring their own bed and bath linens. Mattress covers and pillow covers cannot be used as bedding. Upon request , bed sheets and towels can be rented on site.
DEPARTURE
Departure with the return of keys, always at our offices, must take place at 9:00 amon the day indicated as the end of the stay. Departure should preferably take place during office hours, to allow the agency staff to inspect the condition and cleanliness of the apartment. The apartment must be left in order, free from rubbish, the refrigerator emptied and defrosted, dishes washed, and the kitchen area perfectly clean, otherwise charges of €50.00 will be applied.
SECURITY DEPOSIT
The Customer undertakes from now on to leave the apartment in perfect order. As a guarantee of timely compliance with all behavioral and maintenance rules and correct use of the apartments, the AGENCY, at its sole discretion, may request from the Customer, at the time of key collection, a security deposit of €100.00 (which may vary on some properties). This deposit is refunded after verifying the good condition of the apartmentand without prejudice to the right the agency reserves the right to request any adjustments for the total cost of restoring any damages or various deficiencies suffered, if applicable.
AGENCY'S RESPONSIBILITY
No responsibility can be attributed to the AGENCY for any breakages, accidents, losses, thefts, delays, and inconveniences in general that may occur in the apartment. However, it provides its services to help resolve any problems, provided that any proven damage claims must be agreed upon directly on site. For any legal disputes, the exclusive competent forum is that of Ascoli Piceno.
PARTICULAR RULES
The AGENCY reserves the right, in the event of unforeseen circumstances in the allocation of the booked apartment, to replace it with another of approximately the same or superior typological characteristics, and any additional expenses are borne by the AGENCY. Requests for a specific apartment (number, floor, orientation, view, etc.) are taken into consideration by the AGENCY, although it does not provide a guarantee in this regard. The description of the furniture composition, as well as the photos, displayed on the website, are to be considered indicative and may exceptionally undergo changes. Please note that personnel authorized by the AGENCY may enter the apartments for repairs or maintenance even in the absence of tenants.
ACCEPTANCE
The parties mutually acknowledge that, to the extent not expressly provided for in these general conditions, the lease is exclusively governed by the provisions of the code, as this lease is entered into to meet housing needs for tourist purposes. Pursuant to and for the purposes of Legislative Decree 196/2003, the Tenant expressly authorizes the agency La MER to store in its archives and to use the personal data of the Tenant and their companions, for compliance with the obligations provided for by the laws in force, mailing lists, and commercial communications.
